But in practice, this law has never been observed.
The French legislature has then decided to intervene again developing the law of 4 August 2008 LME called the Law of Modernization of Economy
This law establishes mandatory time limits and penalties as follows:
The GSC: socket trade negotiations
The French law provides that the payment terms must be established in the General Terms and Conditions (GTC). These are the cornerstone of commercial negotiation (Article 441-6 C. com.).
These Terms of Payment must include:
- - the term of payment agreed
At 441-6. 9 of the Commercial Code)
However, the contract of sale or the GCS may set a shorter period than in those 30 days.
Deadlines:
However, the 01/01/2009 term maximum agreed between the parties (art. 441-6 C. com) can not legally exceed:
• 45 days late months
• or 60 days of the invoice date
remember that the French legislation does, however, for some sectors (food, sea or road transport, car hire with or without a driver ...) a mandatory term of 30 days from the date of the invoice.
The new law allows the gradual change of the terms used to get those time limits within the 1/1/2012 through a collective agreement by professional organizations
The collective agreement must be submitted for the competition authority French and then approved by the Decree. To date, 63 agreements were signed. For some of them already have a decree;
Examples:
Textile :
In textiles, the Decree provides for the following maximum:
65 days end of month • 2010
55 days end of month • 2011
• 2012 45 days month end
also part of a plan of financing granted to independent retailers, you can expect an increase of 15 days in 2010 and 10 days in 2011.
No financial compensation can justify compliance with these terms

La DGCCRF, incaricata del buon rispetto delle disposizioni imperative dell’ordine pubblico economico, avrà cura di monitorare che i creditori francesi that might be the terms of payments outside the maxima, in particular through the central payments abroad.
addition DGCCRF will take care of good French debt payments to their foreign creditors in order not to distort competition to the detriment of French operators.
From 1.1.2009, the French companies forced by law to hold annual accounts certified by an auditor (commissaire aux comptes ) must publish information on period of payment from their suppliers or customers. This information is provided by the auditor, whose report will be communicated to the Ministry of Economic Affairs in the event of repeated failure to rule on terms of payment obligations and penalties.
also should be made clear that Article L 442-6 of the Commercial Code states:
engages the responsibility of the author and required to pay damages, if, for any producer, trader, business or person registered to the repertoire of trades:
o …/…

French legislation does not provide any specific penalty for the seller who does not respect the time limits set.
The fact that it grants beyond the limits of the terms can lead to the distortion of competition and as a result of this legitimate legal action against the supplier

Il mancato rispetto di queste menzioni potrebbe essere sanzionato da una multa di un importo massimo di 75.000 € per una person (s € 375,000 for a company - Article 131-31 of the Penal Code), or 50% of the amount billed or invoiced.
